LAREDO, TX. (KGNS) - For the past several weeks, the trial, the verdict and now the sentencing phase of ex-Border Patrol agent Ronald Anthony Burgos Aviles has been broadcasted online.

Burgos was convicted exactly one week ago for killing Grizelda and their son Dominic.

Burgos’ defense addressed their concerns of the public attention the case has gained.

On Thursday morning, the judge granted the defense some accommodations relating to their witnesses.

It was now the states turn to cross-examine one of the defense’ expert witnesses that took the stand Wednesday who testified and gave a presentation on the violence risk assessment done on Ronald Anthony Burgos Aviles.

Before Dr. Mark Cunningham returned to stand, the defense brought up concerns pertaining to some of their witnesses and the publicity surrounding the case.

Judge Joe Lopez granted relief relating to some of the witness for the defense; meaning that some of the defense testimonies will not be broadcasted and their identities will be concealed.

On Thursday afternoon, Dr. Cunningham was cross-examined by the state on how he gathered the data as well as his expert opinion that if Burgos is sentenced to life in prison, he could be an inmate that would be considered low risk in committing violent acts in prison.

The state then questioned the assessment.

The jury still needs to decide if Burgos will be sentenced to prison or death during this phase of case.

On Thursday morning the defense also requested for a mistrial to which Judge Joe Lopez denied that motion.

Below is the last updated version of this story:

Thursday marks exactly one week since Ronald Anthony Burgos Aviles was found guilty of killing Grizelda Hernandez and their son Dominic.

During day five of the sentencing phase, Burgos’ defense asked for a mistrial, although that motion was denied.

Thursday morning started with one juror testing positive for Covid-19 and the defense requesting a mistrial based on the media coverage the case has had so far.

As for the juror with covid, they were discharged, and an alternate was brought in.

Burgos’ defense requested a mistrial saying the publicity of the trial has impacted their client and potential witnesses.

His defense stated that one of their witnesses is resisting a subpoena to appear in court due to concerns of their testimony being broadcasted.

His defense claims that Burgos’ family has also been impacted due to the media coverage.

The defense also requested a change of venue to which the district attorney Isidro Alaniz stated that Grizelda’s and Dominic’s family have had their testimony broadcasted.

The state also referenced the trial of former Border Patrol agent Juan David Ortiz who was convicted of killing four women.

Although the trial was moved to Bexar County, it was also broadcasted.

Although Judge Joe Lopez ruled against a mistrial, he did grant the defense relief in having the identities of some of their witnesses to be concealed and their testimony will not be broadcasted.

Zapata resident files lawsuit against sheriff’s office claiming excessive force

ZAPATA COUNTY, TX (KGNS) - A Zapata County resident has filed a lawsuit against the sheriff’s office and four deputies for the alleged use of excessive force that resulted in the amputation of his leg.

The incident happened during the early morning hours of Feb. 26, 2022, when Rigoberto Barrientos was arguing with his then girlfriend, which escalated in her calling the authorities.

According to the lawsuit, deputies with the Zapata County Sheriff’s Office arrived at the home to assess the situation and found no signs of forced entry or physical harm.

The lawsuit alleges that during questioning, there was a heated exchange between one of the deputies and Mr. Barrientos when they offered to give him a ride to stay at a family member’s house, since the house belonged to his girlfriend, but Barrientos refused resulting in what his attorney is claiming was a violent arrest.

Barrientos’ attorney Kevin Green alleges that the deputies used a very dangerous takedown maneuver.

“His leg bent backwards in the opposite direction that your knee is supposed to bend, so forcefully, that his leg, you can hear it on the video, it makes a horrible crunching popping sound, and it just splits the leg all the way off, except for just a little tissue in the front,” said Barrientos. “The deputies had to apply two tourniquets to save his life because quit literally, Mr. Barrientos was bleeding to death.”

Green also alleges that the sheriff’s deputy falsified the police report saying that Mr. Barrientos attempted to start a fight with the authorities.

Barrientos is seeking roughly half a million dollars for his medical expenses and his attorney is also asking to take this case to trial.

KGNS reached out to the Zapata County Sheriff’s Office several times, and so far, we have not received a response.
